Expedition v Delay: Splitting Liability and Quantum

Following an initiative of Lord Justice May, Deputy Head of Civil Justice, the Clinical Disputes Forum were asked to investigate ways of resolving liability issues early when damages cannot be determined (usually because the patient’s outcome is uncertain or a child claimant is too young to be forecast their future needs with any accuracy.

The Clinical Disputes Forum are gratetul to the Lord Chancellor’s Department for the funding of this project.
